Influencer Emilie Kiser Sues to Keep Details of Son’s Death Private
Emilie Kiser, a 26-year-old social media influencer and popular mommy blogger with over four million TikTok followers, has filed a lawsuit in Arizona to block the release of records related to the tragic death of her three-year-old son, Trigg.
According to the Chandler Police Department, Trigg passed away on May 18—six days after he was found unresponsive in the family’s backyard pool.
The lawsuit, filed under Kiser’s maiden name, Emilie Henrichsen, names several Arizona entities, including the City of Chandler, Chandler Police Department, Maricopa County, and the county’s medical examiner’s office. Kiser is seeking to permanently seal all public records tied to the incident.
The filing describes Kiser as a grieving mother “going through a parent’s worst nightmare” and emphasizes the family’s deep desire to mourn privately. “Trigg’s death has become a media frenzy,” the suit reads. “Shockingly, over 100 public records requests have already been submitted to both the City of Chandler and the Maricopa County Medical Examiner’s Office.”
The lawsuit also notes that Kiser is trying to care for her newborn son, Theodore, while managing her grief. “Every day is a battle,” the suit says.
Her attorneys argue that the records in question likely contain graphic and deeply personal details that serve no purpose in ensuring government accountability. “To allow disclosure in these circumstances would be to turn Arizona’s Public Records Law into a weapon of emotional harm, rather than a tool of government transparency,” the lawsuit states.
Notably, the family has not reviewed any of the available documentation, which includes police reports, security footage, 911 calls, and autopsy photos—and they don’t plan to. Kiser’s legal team said those materials haven’t been made available to them either.
In response to the legal action, Maricopa County spokesperson Jason Berry told NBC News that once the county learned of the family’s intentions, the Office of the Medical Examiner agreed to seal the records in question.
The drowning occurred on May 12 at the family’s Arizona home. According to a neighbor who spoke with DailyMail.com, emergency services rushed to the scene, where five police cars arrived. Paramedics performed life-saving measures before Trigg was airlifted to Phoenix Children’s Hospital.
Since the tragedy, Kiser has remained offline. Before turning off comments, her followers flooded her social media pages with sympathy and words of comfort.
Emilie and her husband, Brady, welcomed Trigg in July 2021. They announced a second pregnancy in September 2024 with a post captioned, “WE GOTTA BABY GROWING,” and shared their excitement about expanding their family.
Their second son, Teddy, was born in March. In a heartfelt Instagram post at the time, the couple wrote, “We love you so much and our hearts feel like they are going to burst.”
